These Terms & Conditions (“Terms”) govern your use of embraerexecjetcharter.com and any services provided by Embraer Executive Jet Charter (“Embraer Executive,” “we,” “our,” or “us”). By accessing our Site or requesting charter services, you agree to these Terms.

1. Embraer Executive’s role

Embraer Executive Jet Charter is an air charter broker. We do not own or operate aircraft and are not a direct or indirect air carrier. All flights we arrange are operated by duly licensed Part 135 air carriers who retain full operational control. Embraer Executive’s role is to source, negotiate, and coordinate travel on your behalf.

2. Eligibility

You must be at least 18 years old and legally able to enter contracts to submit inquiries or purchase services. By providing information, you represent that it is accurate and complete.

3. Quotes & bookings

Quotes are estimates based on availability at the time provided. Final pricing may change due to aircraft repositioning, fuel, airport fees, or schedule adjustments.
A trip is not confirmed until you sign Embraer Executive’s charter agreement and pay the required funds.
All itineraries remain subject to operator availability, weather, regulatory limitations, and safety requirements.
Embraer Executive reserves the right to decline or cancel a booking for safety, compliance, or payment issues.

4. Client responsibilities

Provide accurate passenger information, special requests, and documentation.
Adhere to operator policies (baggage limits, pet rules, dangerous goods restrictions).
Reimburse additional costs (de-icing, hangar, crew overnights, catering upgrades, ground transportation) incurred after trip confirmation.
Maintain valid payment methods and remit funds per invoice terms.

5. Intellectual property

Site content, trademarks, logos, and materials are owned by Embraer Executive or our licensors. You may not copy, distribute, or use them for commercial purposes without written consent.

6. Disclaimer of warranties

The Site and its content are provided “as is.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Embraer Executive does not guarantee continuous, error-free, or secure access to the Site or third-party platforms.

7. Limitation of liability

To the fullest extent permitted by law, Embraer Executive shall not be liable for indirect, incidental, consequential, or punitive damages, including lost profits or business interruption. Embraer Executive’s total liability arising from any claim related to services shall not exceed the amounts you paid to Embraer Executive for the affected trip. Operators remain solely responsible for air transportation.

8. Indemnification

You agree to indemnify and hold harmless Embraer Executive, its officers, employees, and affiliates from any claims, losses, damages, or expenses (including attorney’s fees) arising from your breach of these Terms, misuse of the Site, or violation of applicable laws.

9. Force majeure

Embraer Executive and partner operators are not liable for delays or cancellations caused by events beyond their reasonable control (weather, mechanical issues, strikes, government actions, epidemics, etc.). Additional costs caused by such events are the client’s responsibility.

10. Governing law & venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in New York, NY, unless the parties agree to another forum.

11. Changes to Terms

We may update these Terms at any time. Material changes will be posted on the Site with a revised “Effective date.” Continued use of the Site or booking services after an update signifies acceptance of the new Terms.
